The Court of Appeal in Lagos has dismissed human rights Lawyer Femi Falana's suit to ban public officers from seeking medical treatment abroad. The court ruled that preventing public officers from seeking medical attention outside Nigeria would infringe on their fundamental rights
Falana, a senior advocate of Nigeria had argued that the government's failure to repair and equip public hospitals in Nigeria violated the right to health of Nigerians. but the court upheld the trial court's decision, stating that the provision of adequate medical facilities is not justiciable under the Nigerian Constitution..
